These terms and conditions govern your access to and use of this website. By browsing the site, submitting an enquiry, or subscribing to our mailing list, you agree to be bound by them.

We may amend these terms from time to time, for example to reflect changes in the law, in our stores, or in how the website works. The amended version takes effect from the date it is published on this page, and the “last updated” date at the top of this page will change.

Your continued use of the website after a change is published means you accept the amended terms. We recommend that you review this page occasionally.

You may browse this website, and print or download extracts from it, for your own personal, non-commercial use.

You may not:

• use the website for any unlawful purpose, or in a way that breaches South African law;
• copy, reproduce, republish, sell or commercially exploit any part of the website without our prior written permission;
• use any automated system — including scrapers, robots or spiders — to extract data from the website, or to place an unreasonable load on our infrastructure;
• attempt to gain unauthorised access to the website, its server, or any connected database, or interfere with its proper working;

Unauthorised access to, interception of, or interference with data is a criminal offence under Chapter 13 of ECTA and under the Cybercrimes Act 19 of 2020. We reserve the right to report such conduct to the relevant authorities and to refuse you access to the website.

All content on this website — including text, photographs, illustrations, video, layout, design, and the arrangement of the site — is owned by Romens or used under licence, and is protected by the Copyright Act 98 of 1978 and other applicable laws.

The name “Romens”, the Romens logo, and our other names, marks and get-up are trade marks of Romens. Nothing on this website grants you any right or licence to use them.

Brand names, logos and product images belonging to the labels we stock remain the property of their respective owners and are shown to identify the goods we sell in store.

This website is a showcase for the ranges carried in our stores. It is not an online shop, and no sale is concluded through this website.

We take care to describe our products accurately, but:

• photographs are indicative — colour reproduction varies between screens, and fabric, texture and shade may differ from what you see;
• stock, sizes and ranges differ between our three stores and change continually. Availability shown on the site is not a guarantee that an item is in stock at a particular store;
• prices are quoted in South African Rand and include VAT unless stated otherwise. Prices may change without notice, and the price displayed in store at the time of purchase is the price that applies.

Where an obvious error appears — for instance a price or description that is plainly wrong — we are not obliged to honour it, in line with section 23(9) of the Consumer Protection Act 68 of 2008 (“CPA”). We will correct the error and let you know as soon as we reasonably can.

Please phone the relevant store to confirm stock, size or price before travelling.

Purchases are concluded in our stores, and the CPA applies to them in full. Your rights when goods are defective, and our exchange arrangements, are set out in our Exchanges & Returns policy.

Nothing on this website limits or replaces any right you have under the CPA.

When you send us an enquiry through the website, or subscribe to our mailing list, you provide personal information that we handle in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (“POPIA”).

You agree that the information you give us is accurate and that you are entitled to provide it. Please do not send us confidential information, payment card details, or identity numbers through a website form.

We aim to reply to enquiries within one working day. Messages sent over a weekend or public holiday are answered on the next working day. We cannot guarantee that any electronic message will reach us, and an enquiry only binds us once we have confirmed it.

You may unsubscribe from our mailing list at any time using the link in any message we send, or by contacting any of our stores.

This website may link to third-party sites, including social media platforms and the websites of the brands we stock. Those links are provided for convenience only.

We do not control those sites, we do not endorse their content, and we are not responsible for them or for any loss you may suffer from using them. Their terms and privacy policies — not ours — govern your use of them.

We try to keep the website available and working properly, but we do not guarantee uninterrupted or error-free access. We may suspend, withdraw or restrict all or part of the website for business or operational reasons, including maintenance, without notice.

You are responsible for the arrangements you need to access the website, including your own device, connectivity and security software.

The website and its content are provided “as is”. To the fullest extent permitted by law, and subject to the paragraph on your consumer rights below, we do not warrant that:

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded, including our liability under sections 55, 56 and 61 of the CPA.

You indemnify Romens against any claim, loss, damage or expense (including reasonable legal costs) arising from your breach of these terms, your unlawful use of the website, or any content you submit to us.

We process personal information in accordance with POPIA. Our Privacy Policy explains what we collect, why we collect it, who we share it with, how long we keep it, and the rights you have as a data subject.

Our Cookie Policy explains the cookies this website sets and how to control them.

Certain clauses in these terms limit our liability, place a risk or an obligation on you, or require you to indemnify us. Those clauses are drawn to your attention in accordance with section 49 of the CPA. They appear under the headings “Using this website”, “Disclaimers”, “Limitation of liability” and “Indemnity”.

Please read them carefully. If you do not understand a clause, ask us before you use the website — we will explain it. By using the website you acknowledge that you have had the opportunity to read these terms, that you understand them, and that you accept the risks they describe.

If you are unhappy with anything we have done, please raise it with us first — most matters are settled quickly. Contact the store concerned, or write to us using the details at the end of this page. We will acknowledge your complaint and work with you to resolve it.

If we cannot resolve the matter between us, you may refer it to:

• the Consumer Goods and Services Ombud — www.cgso.org.za, 0860 000 272;
• the National Consumer Commission — www.thencc.gov.za;
• the Information Regulator, for complaints about how we handled your personal information; or
• a court of competent jurisdiction.

Referring a dispute to an ombud or regulator does not affect any other right you have in law.

These terms, and any dispute arising from them or from your use of this website, are governed by the law of the Republic of South Africa.

You consent to the jurisdiction of the Magistrate’s Court having jurisdiction over you in terms of section 45 of the Magistrates’ Courts Act 32 of 1944, even where the claim would otherwise exceed that court’s limits. This does not prevent us from bringing proceedings in a High Court where we are entitled to do so.

• Whole agreement. These terms, together with the policies they refer to, are the whole agreement between you and us about your use of this website.
• Severability. If any clause is found to be unenforceable, it is severed and the remaining clauses continue to apply.
• No waiver. If we do not enforce a right, that is not a waiver of it.
• Cession. You may not cede or assign your rights under these terms. We may cede ours as part of a sale or restructure of our business.
• Notices. Notices to us must be sent to the address at the end of this page. We may send notices to you at the email address you gave us.
